Article 1 These Regulations are formulated in accordance with the Mine Safety Law of the People's Republic of China (hereinafter referred to as the Mine Safety Law).
Article 2 The meaning of the following terms in the Mine Safety Law and these Regulations:
Mine refers to the place where mineral resources mining activities and their ancillary facilities are carried out within the mine area approved by law.
The exploitation of mineral resources refers to the exploration of mineral resources and the construction, production, closure and related activities of mineral resources within the scope of mining areas approved according to law.
Article 3 The State adopts policies and measures to support the development of mine safety education, encourage the research and promotion of safe mining technology, safety management methods, safety equipment and instruments, and promote the scientific and technological advancement of mine safety.
Article 4 The people's governments at various levels, relevant government departments or enterprises and institutions shall reward units and individuals that have one of the following circumstances in accordance with relevant state regulations:
(1) In the mine safety management and supervision work, loyal to the duties and make outstanding achievements;
(2) Preventing mine accidents or emergency rescues from contributing;
(3) making remarkable achievements in promoting mine safety technology and improving mine safety facilities;
(4) Proposing rationalization proposals for mine safety production with remarkable results;
(5) There are inventions and scientific research achievements in improving mine working conditions or preventing mine accidents, and the results are remarkable.
[ç« ç« ] Chapter 2 Safety of Mine Construction
Article 5 The geological exploration report used for mine design shall include the following technical materials:
(1) The nature and scale of larger faults, fracture zones, landslides, and debris flows; [next]
(2) The lithology, layer thickness, occurrence of aquifers (including karst caves) and aquifs, hydraulic connections between aquifers, surface water and groundwater, phreatic water level, water quality, water volume and flow direction, ground The water flow system and the hydrophobic capacity of the relevant water conservancy projects, as well as the local precipitation and the highest flood level over the years;
(3) The distribution range, mining depth and water accumulation of the original small kiln and old kiln within the scope of mine design;
(4) The occurrence of biogas and carbon dioxide, the possibility of natural mineral ignition and mineral dust explosion;
(5) The composition, content and variation of minerals harmful to the human body, and the natural radioactive background data of the exploration area for at least one year;
(6) Geothermal anomalies and rock thermal conductivity, geothermal gradient, hot water source, water temperature, water pressure and water volume in the hot water mining area, and the range of the thermal damage zone;
(7) Water sources and water quality for industrial and domestic water use;
(8) Drilling and sealing information;
(9) Other materials required for mine design.
Article 6 The feasibility study report and overall design of the mine construction project shall be compiled, and the safety conditions of the mine exploitation shall be demonstrated.
The preliminary design of the mine construction project shall prepare a special safety article. The requirements for the preparation of safety special articles shall be prescribed by the competent labor administrative department of the State Council.
Article 7 According to the provisions of Article 8 of the Mine Safety Law, when the mine construction unit submits the design documents for the safety construction of the mine construction project to the competent department of the management of the mining enterprise, it shall submit it to the labor administrative department for review; The review opinion of the administrative department shall not be approved by the competent department of the mining enterprise.
When the design of the approved safety construction of the mine construction project needs to be revised, the opinions of the labor administrative department that originally participated in the examination shall be solicited.
Article 8 The mine construction project shall be constructed in accordance with the approved design documents to ensure the construction quality; after the project is completed, it shall apply for acceptance according to the relevant provisions of the State.
The construction unit shall submit to the competent department of the mining enterprise and the competent labor administrative department a comprehensive report on the construction and completion of the safety construction of the mine construction project 60 days before the acceptance.
Article 9 The competent department of the mining enterprise and the competent labor administrative department shall inspect the safety facilities of the mine construction project within 30 days from the date of receiving the comprehensive report on the construction and completion of the safety construction of the mine construction project submitted by the construction unit. If it does not meet the mine safety regulations and industry technical specifications, it shall not be accepted and shall not be put into production or use.
Article 10 Mines shall have safety facilities that guarantee safe production, prevent accidents and occupational hazards, and meet the following basic requirements:
(1) Each mine has at least two independent safety exits that can directly reach the ground. Each production level (middle section) of the mine and each mining area (panel) have at least two pedestrian-safe exits and are connected to the exit directly to the ground.
(2) Each mine has an independent ventilation system that uses mechanical ventilation to ensure sufficient airflow in the underground operation site; however, small non-biogas mines can use natural ventilation on the premise of ensuring the required air volume at the downhole work site.
(3) The section of the roadway can meet the needs of installation, maintenance and construction of pedestrians, transportation, ventilation and safety facilities and equipment.

(5) There are enough safety isolation pillars between adjacent mines, between mines and open pit mines, and between mines and old kiln. There are enough pillars or pillars to ensure the safety of the wells and underground wells in the mine shaft layout.

(11) The ground and underground power supply and distribution systems comply with relevant state regulations.
(12) The mine lifting transportation equipment , installations and facilities meet the following requirements:

2) there is sufficient clearance between the lifting container and the well wall, the tank rail and between the two lifting containers;
3The lifting winch and the lifting container have reliable safety protection devices;

5. The mechanical equipment of the transport personnel has reliable safety protection devices;

(13) Each mine has a dust-proof water supply system. All dust-producing locations on the ground and downhole are integrated with dust protection.
(14) Mines with the possibility of gas and dust explosions shall be equipped with explosion-proof electrical equipment and shall be protected against dust and explosion.
(15) Mines that mine radioactive minerals meet the following requirements:
1 The intake air volume and wind quality of the mine can meet the needs of hail reduction, avoiding series ventilation and sewage circulation;

[ç« ç« ] Chapter III Safety Protection of Mining
Article 11 Mining operations shall prepare operational procedures, stipulate technical and organizational measures to ensure the safety of operators, and modify and supplement them in a timely manner when the situation changes.
Article 12 Mining shall have the following drawings and materials:
(1) Geological maps (including hydrogeological maps and engineering geological maps);
(2) The general layout of the mine and the upper and lower mine map of the mine;
(3) Maps of mines, roadways and stopes;
(4) The main system diagram of mine production and safety guarantee.
Article 13 Mining enterprises shall mine in the scope approved by mining licenses, and prohibit cross-layer and cross-border mining.
Article 14 The following equipment, equipment, protective equipment and safety testing instruments used by mines shall comply with national safety standards or industrial safety standards; if they do not meet national safety standards or industrial safety standards, they shall not be used:
(1) Excavation, support, loading, transportation, lifting, ventilation, drainage, gas drainage, compressed air and lifting equipment;
(2) Electric motors, transformers, power distribution cabinets, electrical switches, and electronic control devices;
(3) Blasting equipment , communication equipment, miner's lamps, cables, wire ropes, supporting materials, fireproof materials;
(4) Various safety and health testing instruments and meters;
(5) Protective equipment and ambulance equipment such as self-rescuers, helmets, dust-proof respirator or masks, protective clothing, protective shoes, etc.;
(6) Other equipment and equipment that have been identified by the relevant competent authority and have special safety requirements.
Article 15 Mining enterprises shall regularly inspect and repair electromechanical equipment, its protective devices and safety testing instruments, and establish technical files to ensure safe use.
Personnel not responsible for the operation of the equipment shall not operate the equipment. Non-duty electrical personnel are not allowed to perform electrical work. Personnel operating electrical equipment should have reliable insulation protection. Do not carry live work when servicing electrical equipment.
Article 16 The concentration of toxic and hazardous substances in the air of mine operations shall not exceed national standards or industry standards; mining enterprises shall, in accordance with the methods prescribed by the State, regularly inspect according to the following requirements:
(1) Dust operation points, which are tested at least twice a month;
(2) Trinitrotoluene operating point, which is tested at least once a month;
(3) The operating point of radioactive materials shall be tested at least three times a month;
(4) Other toxic and hazardous substances operating points, which are inspected at least once a month in the underground, and the ground is tested at least once every quarter;
(5) The use of individual sampling methods to detect respiratory dust is detected at least once a quarter. [next]
Article 17 The underground mining operations must be managed in accordance with the provisions of the operating procedures. When mining operations pass through geological fracture zones or other top-fighting locations, support should be strengthened.
For open-pit mining operations, the height, width, slope angle and final slope angle of the mining and stripping face shall be controlled in accordance with the design regulations. Mining and stripping operations shall not cause damage to deep or adjacent wells.

Article 19 In the case of mining under the following conditions, special design documents shall be prepared and reported to the competent authorities of the mining enterprise for approval:

(4) mining under the water body;
(5) Mining in areas where the ground temperature is abnormal or there is hot water pouring out.
Article 20 The following measures shall be taken for mines that have the possibility of spontaneous combustion:
(1) Clearing up the floating ore and other combustible materials in the stope in time, and closing the gobs in time after the end of mining;
(2) adopting fireproof grouting or other effective measures to prevent spontaneous fires;
(3) Regularly check the closure of the roadway and the mining area, determine the temperature and air volume of the place where the natural fire may occur; periodically check the temperature, air pressure and air composition in the fire zone.
Article 21 When one of the following situations occurs in underground mining operations, it is necessary to explore the water:
(1) When it is close to a confined aquifer or a water-bearing fault, a flowing sand layer, a gravel layer, a cave, or a collapse column;
(2) When it is close to the geological fracture zone that communicates with the surface water body or the unsealed borehole that is close to the connected pressure layer;
(3) When the old kiln, the old alley, or the gob filled with mud is close to the stagnant water;
(4) When there is a sign of water;
(5) When digging open pillars or rock pillars to release water.
Article 22 The downhole air volume, wind quality, wind speed and operating environment climate must comply with the provisions of the mine safety regulations.
In the inlet airflow of the mining face, according to the volume calculation, the oxygen should not be lower than 20%, and the carbon dioxide should not exceed 05%.
The air temperature at the underground working site shall not exceed 28 °C; when exceeded, cooling or other protective measures shall be taken.
Article 23 The mines that mine radioactive minerals must take the following measures to reduce the amount of radon gas released:
(1) Closing the goaf and the wells that have been scrapped or temporarily unused;
(2) Downwind ventilation is adopted in the stope that is operated by the method of retaining ore;
(3) Strictly manage underground sewage. [next]
Article 24 The blasting operations of mines and the manufacture, storage, transportation, testing and destruction of blasting materials must strictly implement relevant state regulations.
Article 25 Mining enterprises shall adopt comprehensive dust-proof measures to control dust hazards in the operation of dust generated on the ground and underground.

Article 26 Mining enterprises shall establish and improve the inspection and maintenance systems for ground subsidence areas, dumping sites, waste rock hills and tailings ponds; preventive measures shall be taken for possible hazards.
Article 27 Mining enterprises shall close mines in accordance with relevant state regulations and take preventive measures against the hazards that may be caused after the mines are shut down. Closing the mine report should include the following:
(1) The scope of mining and the treatment of the goaf;
(2) Closed measures taken against the mine;
(3) Methods for dealing with other unsafe factors.
[ç« ç« ] Chapter 4 Safety Management of Mining Enterprises
Article 28 Mining enterprises shall establish and improve the following safety production responsibility systems:
(1) The responsibility system for safe production of administrative leadership positions;
(2) The responsibility system for the safety production of functional organizations;
(3) The responsibility system for the safety of the post personnel.
Article 29 The mine manager (including the Director of the Mining Bureau, the manager of the mining company, the same below) shall bear the following responsibilities for the safe production of the enterprise:
(1) Conscientiously implement the Mine Safety Law and these Regulations and other laws and regulations on mine safety production;
(2) Formulating the safety production management system of the enterprise;
(3) Equipped with qualified safety personnel as required, and carry out follow-up inspections for each workplace;
(4) taking effective measures to improve the working conditions of employees and ensure the timely supply of materials, equipment, instruments and labor protection articles required for safe production;
(5) Conducting safety education and training for employees in accordance with the provisions of these Regulations;
(6) Formulating prevention and contingency plans for mine disasters;
(7) Taking timely measures to deal with hidden dangers in the mine;
(8) Reporting the mine accident to the competent labor administrative department and the competent department of the mining enterprise in a timely and truthful manner.
Article 30 Mining enterprises shall set up safety agencies or provide full-time safety staff according to their needs. Full-time safety staff should be trained, have the necessary safety expertise and mine safety work experience, and be competent for on-site safety inspections.
Article 31 The mine manager shall report the following matters to the employee representative assembly or the employee assembly on a regular basis and accept democratic supervision:
(1) Major decisions on safe production of enterprises;
(2) Enterprise safety technical measures plan and its implementation; [next]
(3) Staff safety education, training plans and their implementation;
(4) The handling of suggestions and requirements for improvement of working conditions proposed by employees;
(5) The handling of major accidents;
(6) Other important matters concerning safe production.
Article 32 Workers of mining enterprises enjoy the following rights:
(1) The right to obtain information on the safety and occupational hazards of the workplace;
(2) The right to reflect the mine safety status and existing problems to the relevant departments and trade union organizations;
(3) It has the right to criticize, report and accuse any decision or act that endangers the safety and health of its employees.
Article 33 The employees of mining enterprises shall perform the following obligations:
(1) to abide by laws, regulations and enterprise rules and regulations concerning mine safety;
(2) Maintaining the production equipment and facilities of the mining enterprise;
(3) Accepting safety education and training;
(4) Reporting dangerous situations in time and participating in emergency rescue.
Article 34 The trade unions of mining enterprises have the right to urge the administrative aspects of enterprises to strengthen the safety education and training of employees, carry out safety publicity activities, and improve the workers' awareness of safety production and technical quality.
Article 35 Mining enterprises shall conduct safety education and training for employees in accordance with the following provisions:
(1) The employees of underground operations in newly-introduced mines shall not receive less than 72 hours of safety education and training. After passing the examination, they must work for 4 months under the leadership of employees with safe working experience, and then pass the examination again. Can work independently;
(2) Employees of newly-opened open pit mines shall not receive less than 40 hours of safety education and training, and may only be employed after passing the examination;
(3) Those who change the type of work and use the new technology must re-train and pass the examination before they can work on the job;
(4) All production operations personnel shall receive on-the-job safety education and training for not less than 20 hours per year.
During the period of employee safety education and training, mining enterprises shall pay wages.
Staff safety education, training and assessment results shall be recorded and archived.
Article 36 The safety education and training of mining enterprises on employees shall include the following contents:
(1) The Mine Safety Law and the rights and obligations of the mine employees granted by this Regulation;
(2) Mine safety regulations and rules and regulations concerning the safety management of mining enterprises;
(3) Safety knowledge related to the employee's own work;
(4) Identification of various accident signs, emergency measures and evacuation routes in the event of an emergency;
(5) the use of self-rescue equipment and knowledge about first aid; [next]
(6) Other contents as stipulated by the relevant competent department.

Article 38 The assessment of the mine's safety qualifications shall include the following contents:
(1) The Mine Safety Law and relevant laws, regulations and mine safety regulations;
(2) Mine safety knowledge;
(3) Safety production management capabilities;
(4) The ability to handle mine accidents;
(5) Safety production performance.
Article 39 The labor protection articles issued by mining enterprises to employees shall be products that have passed the appraisal and inspection. The standards for the issuance of labor protection articles shall be formulated by the competent labor administrative department of the State Council.
Article 40 Mining enterprises shall prepare mine disaster prevention and contingency plans every year; at the end of each quarter, the plans shall be revised in time according to actual conditions, and corresponding measures shall be formulated.
Mining enterprises should familiarize each employee with mine disaster prevention and contingency plans, and organize at least one mine disaster drill every year.
Mining enterprises shall, in accordance with relevant state regulations, set mine safety signs in accordance with the requirements of different workplaces.
Article 41 A mining enterprise shall establish a mine rescue and medical emergency organization composed of full-time or part-time personnel. Small mining enterprises that do not have a separate professional ambulance and medical emergency organization, in addition to the establishment of part-time ambulance and medical emergency organizations, should also sign ambulance and first aid agreements with neighboring mining companies with professional ambulance and medical emergency organizations, or Establish professional ambulance and medical emergency organizations in conjunction with neighboring mining companies.
Mine rescue and medical emergency organizations should have fixed sites, training equipment and training venues.
The scale and equipment standards of mine rescue and medical emergency organizations shall be prescribed by the relevant competent department of the State Council to manage mining enterprises.
Article 42 Mining enterprises must produce in accordance with the safe conditions stipulated by the state, and arrange a part of the funds for the following projects to improve the safe production conditions of mines:
(1) Safety technical measures to prevent mine accidents;
(2) Technical measures for occupational health prevention of occupational hazards;
(3) Safety training for employees;
(4) Other technical measures to improve the safe production conditions of mines. [next]
The funds required for the preceding paragraph shall be paid by the mining enterprise according to the proportion of 20% of the mine maintenance fee; the mining enterprise without the mine maintenance fee shall be paid according to the proportion of 20% of the depreciation of fixed assets.

Article 43 The labor administrative department of the people's government at or above the county level shall be equipped with mine safety supervision personnel according to the actual needs of the mine safety supervision work.
Mine safety supervisors must be familiar with mine safety technical knowledge, have mine safety work experience, and be competent for mine safety inspection work.
Mine safety supervision certificates and special signs shall be uniformly produced by the competent labor administrative department of the State Council.
Article 44 When performing their duties, mine safety supervisors have the right to enter the on-site inspection, attend relevant meetings, access relevant materials without compensation, and obtain information from relevant units and personnel.
When the mine safety supervision personnel enters the on-site inspection and finds that there is a situation that threatens the safety and health of the employees, they have the right to request the mining enterprise to immediately correct or solve the problem within a time limit; in case of emergency, the mining enterprise has the right to immediately stop the operation and withdraw the operation personnel from the danger zone. .
The competent labor administrative department may entrust the testing organization to conduct random inspections on the mining operations site and the equipment, instruments and equipment that are in high risk.
The competent labor administrative department shall, in the case of violations of the Mine Safety Law and these Regulations and other laws and regulations concerning mine safety, shall submit handling opinions in accordance with the law.
Article 45 When conducting safety official duties, mine safety supervision personnel shall produce mine safety supervision certificates, enforce the law impartially, and abide by relevant regulations.
[ç« ç« ] Chapter 6 Treatment of Mine Accidents
Article 46 After an accident occurs in a mine, the relevant personnel at the scene of the accident shall immediately report the mine manager or relevant competent personnel; after receiving the accident report, the mine manager or relevant competent personnel must immediately take effective measures to organize the rescue and prevent the accident from expanding. Reduce casualties and property damage.
Article 47 After a serious accident or death in a mine, the mining enterprise shall truthfully report to the competent labor administrative department and the competent department of the mining enterprise within 24 hours.
Article 48 The competent labor administrative department and the competent department in charge of mining enterprises shall report to the people's government at the same level immediately after receiving a fatal accident or an accident report involving more than three people, and report to their respective higher authorities.
Article 49 In the event of a casualty accident, the mining enterprise and the relevant unit shall protect the scene of the accident; when it is necessary to move some parts of the site due to the rescue accident, it is necessary to make a sign, draw a scene map of the accident, and record in detail; After the measures are taken, production can resume.
Article 50 After a mine accident occurs, the relevant departments shall conduct accident investigation and handling in accordance with relevant state regulations.
Article 51 The investigation and handling of mine accidents shall be completed within 90 days from the date of the accident; in case of special circumstances, it may be extended appropriately, but not more than 180 days. After the mine accident is handled, the result of the treatment shall be announced.
[ç« ç« ] Chapter VII Legal Responsibility [next]
Article 52 Where a fine is imposed in accordance with the provisions of Article 40 of the Mine Safety Law, it shall be implemented in accordance with the following provisions:
(1) If safety training and training are not carried out for employees, and a staff member is assigned to work on the job, a fine of less than 40,000 yuan shall be imposed;
(2) Those who use equipment, equipment, protective equipment and safety testing equipment that do not meet the national safety standards or industrial safety standards shall be fined not more than 50,000 yuan;
(3) If the special expenses for safety technical measures are not extracted or used in accordance with the regulations, a fine of not more than 50,000 yuan shall be imposed;
(4) Refusing the on-site inspection of the mine safety supervision personnel or concealing the hidden dangers of the accident when being inspected, and failing to reflect the situation as it is, a fine of not more than 20,000 yuan;
(5) If the mine accident is not reported in a timely and truthful manner in accordance with the regulations, a fine of not more than 30,000 yuan shall be imposed.
Article 53 If a fine is imposed in accordance with the provisions of Article 43 of the Mine Safety Law, the penalty shall be between 50,000 yuan and 100,000 yuan.
Article 54 Violation of Articles 15, 16, 16, 18, 19, 20, 21, 22 of these Regulations, Articles 23 and 25 shall be ordered by the competent labor administrative department to make corrections and may be fined not more than 20,000 yuan.
Article 55 After receiving the notice of fine, the party shall pay the fine to the designated financial institution within 15 days; if it fails to pay within the time limit, it shall charge a late fee of 3 baht from the date of overdue.
Article 56 If a person in charge of a mining enterprise has one of the following acts, causing a mine accident, disciplinary action shall be taken in accordance with the provisions; if a crime is constituted, the judicial organ shall pursue criminal responsibility according to law:
(1) Violating the rules, forcing workers to violate regulations and taking risks;
(2) Turning a blind eye to the repeated violations of the workers and not stopping them;
(3) failing to take measures in time for the warning of a major accident or the hidden dangers discovered;
(4) Failure to implement the supervision instructions of the competent labor administrative department or not adopting the rectification opinions put forward by the relevant departments, causing serious consequences.
[ç« ç« ] Chapter VIII Supplementary Provisions
Article 57 The competent department of the State Council that manages mining enterprises shall report to the competent labor administrative department of the State Council for the record in accordance with the Mine Safety Regulations and industry technical specifications revised or formulated in accordance with the Mine Safety Law and these Regulations.
